Please read these Terms carefully before using our website or purchasing any product.

Nothing in these Terms is intended to exclude or restrict any consumer rights that cannot lawfully be excluded or restricted under applicable law.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are legally capable of entering into a binding contract under the laws applicable to you.

When using our Services or placing an order, you may be required to provide information including your name, email address, billing address, shipping address, payment information and other relevant information.

You agree that all information you provide to us is accurate, complete and current.

You are responsible for maintaining the confidentiality of any account credentials associated with your account and for all activities carried out through your account.

You must not use our Services for unlawful purposes or in a manner that violates these Terms or applicable law.

We reserve the right to suspend or terminate accounts where we reasonably believe that the account has been used fraudulently, unlawfully or in violation of these Terms.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, specifications, images and prices displayed on our website are accurate and up to date.

However, product images and colours may appear differently depending on your device, display settings and other technical factors.

Product specifications, features, availability and descriptions may be updated from time to time.

We reserve the right to discontinue products or limit quantities available for purchase, subject to applicable law.

Handheld Chainsaws and Power Equipment

Our products may include handheld chainsaws and other powered cutting equipment.

Chainsaws are potentially dangerous machines and must only be used in accordance with the manufacturer's instructions and applicable safety requirements. HSE guidance states that chainsaws can cause fatal or major injuries if they are not used correctly.

Before using any chainsaw purchased from us, you should:

  • Read and understand the manufacturer's operating instructions.
  • Follow all safety warnings and instructions supplied with the product.
  • Use appropriate personal protective equipment.
  • Ensure that guards, safety devices and other protective features are correctly installed and functioning.
  • Inspect the product before each use.
  • Do not use the product if it appears damaged, defective or unsafe.
  • Do not modify or remove safety devices.
  • Keep children and unauthorised persons away from the operating area.
  • Use the product only for its intended purpose.

Where chainsaw operation is undertaken as part of work or professional activity, appropriate training and competence may be required.

You are responsible for ensuring that your use of the product complies with applicable laws and safety requirements.

SECTION 3 – ORDERS

When you place an order through our website, you are making an offer to purchase the selected products.

Your order will be subject to our acceptance and product availability.

We reserve the right to refuse or cancel an order where, for example:

  • The product is unavailable.
  • There is an obvious pricing or product description error.
  • We suspect fraudulent or unlawful activity.
  • We are unable to verify the information provided.
  • Delivery to the selected destination is unavailable.
  • The order would breach applicable law or product safety requirements.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order using the original payment method, subject to applicable law.

You should carefully check your order before submitting it.

Your purchases are subject to our Returns & Refund Policy, which forms part of these Terms.

SECTION 4 – PRICES AND BILLING

All prices displayed on our website are subject to change.

The price applicable to your order will normally be the price displayed at the time you place your order and will be confirmed in your order confirmation.

Unless otherwise stated, delivery charges and any applicable taxes, duties or other charges will be displayed during checkout where applicable.

We reserve the right to correct pricing errors and other obvious errors in product listings.

If an obvious pricing error affects an order, we may contact you before fulfilling the order or cancel the order and provide an appropriate refund.

You agree to provide accurate and complete billing and payment information.

You confirm that you are authorised to use the payment method provided for your purchase.

SECTION 5 – SHIPPING AND DELIVERY

We will make reasonable efforts to dispatch and deliver your order within the estimated delivery period shown at checkout.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, customs procedures, severe weather, strikes, transportation disruption or other events beyond our control.

For consumer purchases in the UK, nothing in this section limits any delivery rights you may have under applicable consumer law.

We may use third-party delivery companies to transport orders.

Because some products may contain batteries, electrical components or other regulated materials, certain products may be subject to carrier restrictions or special transportation requirements.

We may contact you if additional information is required to safely and lawfully deliver your order.

These links may be provided for convenience or informational purposes.

We do not control third-party websites and are not responsible for their content, availability, security, policies or practices.

You access third-party websites at your own risk.

Any transaction made through a third-party website is subject to that third party's terms and policies.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our online store is hosted and powered by Shopify.

However, any purchase you make through our store is a transaction between you and AA PROPERTY MANAGEMENT AND SERVICES LTD.

Shopify provides the technology platform that enables us to operate the store but is not the seller of the products purchased from us.

To the extent permitted by law, Shopify and its affiliates are not responsible for the products sold by us or for disputes arising directly between you and us regarding those products.

SECTION 10 – PRIVACY POLICY

Your personal information is handled in accordance with our Privacy Policy.

By using our Services, you acknowledge that you have reviewed our Privacy Policy.

Because our store is powered by Shopify, Shopify may process certain information relating to your use of our website and transactions.

Your information may also be processed by payment providers, delivery providers, fraud-prevention services and other service providers where necessary to operate our business.

For more information, please review our Privacy Policy.

SECTION 11 – FEEDBACK AND REVIEWS

If you submit reviews, comments, suggestions, photographs, videos or other content to us ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display that Feedback for the purposes of operating, improving and promoting our Services, subject to applicable law.

You confirm that you have the necessary rights to submit the Feedback.

  • Infringes another person's intellectual property rights.
  • Contains malware or malicious code.
  • Contains abusive, threatening or defamatory material.
  • Violates another person's privacy.
  • Impersonates another person.

We reserve the right to remove Feedback that violates these Terms or applicable law.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally information on our website may contain typographical errors, inaccuracies or omissions relating to:

  • Product descriptions
  • Prices
  • Promotions
  • Availability
  • Shipping charges
  • Delivery times
  • Product specifications

We reserve the right to correct such errors and update information.

Where an error materially affects an order, we may contact you and, where permitted by law, cancel or amend the affected order.

Nothing in this section affects your statutory consumer rights.

You may use our Services only for lawful purposes.

You must not use our website:

  • For any unlawful purpose.
  • To violate applicable laws or regulations.
  • To infringe intellectual property rights.
  • To transmit malicious software.
  • To engage in fraud or fraudulent transactions.
  • To provide false or misleading information.
  • To interfere with the operation or security of our website.
  • To attempt to gain unauthorised access to our systems.
  • To collect personal information unlawfully.
  • To conduct unauthorised scraping or automated data collection.
  • To impersonate another person or business.
  • To interfere with other customers' use of the Services.

We may suspend or terminate access where we reasonably believe that these Terms have been violated.

SECTION 14 – AUTOMATED ACCESS AND AGENTS

You must not use automated systems, bots, scripts, scraping tools or autonomous agents to access, copy, extract or interact with our website in a manner that:

  • Circumvents security measures.
  • Places an unreasonable load on our systems.
  • Extracts website content for unauthorised commercial use.
  • Interferes with the operation of our Services.
  • Violates applicable law.

We may implement technical measures to restrict automated access where reasonably necessary to protect our website, customers and business.

SECTION 15 – TERMINATION

We may suspend or terminate your access to our Services where permitted by law if you materially breach these Terms or use the Services unlawfully.

Termination will not affect rights or obligations that arose before termination.

Any provisions that by their nature should continue after termination will remain effective, including provisions concerning intellectual property, liability, indemnification, governing law and dispute resolution.

SECTION 16 – PRODUCT SAFETY AND WARRANTIES

We take product safety seriously.

Products supplied through our website are intended to be used in accordance with the manufacturer's instructions, safety warnings and applicable laws.

For machinery sold in Great Britain, applicable product safety and machinery requirements may apply. New machinery placed on the Great Britain market must meet applicable requirements, including appropriate marking, conformity documentation and English-language instructions where required.

We do not permit customers to modify, disable or remove safety features from products.

Do not use a chainsaw if it is damaged, defective or appears unsafe.

If you believe that a product presents a safety risk, stop using it immediately and contact us at:

vajesudamraghuvaje@gmail.com

We may request photographs, videos, product serial numbers or other information to assess the issue.

Nothing in these Terms excludes or limits statutory rights or liability that cannot legally be excluded or limited.

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, we will not be liable for losses that are not reasonably foreseeable or that arise indirectly from your use of our Services.

However, nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of statutory consumer rights.
  • Liability that cannot legally be excluded or limited.
  • Any other liability that applicable law does not permit us to exclude or limit.

We are not responsible for damage caused by misuse, unauthorised modification, failure to follow safety instructions, improper maintenance or use of a product contrary to the manufacturer's instructions, except where applicable law provides otherwise.

Because chainsaws are potentially dangerous machinery, customers must follow all applicable operating and safety instructions.

SECTION 18 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses reasonably arising from your unlawful use of our Services or your material breach of these Terms.

This does not apply to the extent that the loss was caused by our breach of contract, negligence, unlawful conduct or any other circumstance for which we are legally responsible.

Nothing in this section limits your statutory consumer rights.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be modified or removed only to the extent necessary.

The remaining provisions will continue to apply.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

These Terms, together with our Privacy Policy, Returns & Refund Policy and any other policies expressly incorporated into these Terms, constitute the agreement between you and us regarding your use of our Services.

If any provision conflicts with mandatory consumer protection law, the mandatory law will prevail.

SECTION 21 – ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our prior written consent, except where permitted by applicable law.

We may transfer our rights and obligations under these Terms where permitted by law, including in connection with a business restructuring, sale or transfer of the business.

SECTION 22 – GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws of your country or place of residence provide otherwise.

Where applicable law permits, the courts of England and Wales will have jurisdiction over disputes arising from these Terms.

If you are a consumer residing elsewhere in the United Kingdom or another jurisdiction, you may also have the right to bring proceedings in the courts of your place of residence where applicable.

Nothing in this section removes any mandatory consumer rights you may have.

SECTION 23 – HEADINGS

The headings used in these Terms are provided for convenience only and do not affect the interpretation of the provisions.

SECTION 24 – CHANGES TO THESE TERMS

We may update these Terms from time to time.

The latest version will be posted on this page with the applicable "Last updated" date.

Where required by law, we will provide appropriate notice of material changes.

Your continued use of our Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

RETURNS, REFUNDS AND 14-DAY CANCELLATION

Our separate Returns & Refund Policy forms part of these Terms.

For eligible online consumer purchases, we provide a 14-day return/cancellation period.

Generally, customers should notify us within 14 days of receiving the goods if they wish to cancel an eligible distance purchase.

After notifying us, the goods should be returned in accordance with our return instructions and applicable law.

For a change-of-mind return, products should be handled only to the extent reasonably necessary to establish their nature, characteristics and functionality. Where a product has been handled beyond what is reasonably necessary and its value has been diminished, applicable law may allow a corresponding deduction from the refund.

For a handheld chainsaw, customers should not operate, start, test-cut with or otherwise use the chainsaw if they intend to return it under a change-of-mind cancellation right.

This does not affect your statutory rights concerning faulty, damaged, misdescribed or unsafe goods.

UK consumer law provides additional rights for goods that are faulty or do not conform to the contract. In particular, the Consumer Rights Act 2015 provides statutory remedies for goods that do not meet required standards, including a short-term right to reject faulty goods in qualifying circumstances.

For this reason, our 14-day policy does not replace or restrict your statutory rights.

HANDHELD CHAINSAW SAFETY NOTICE

WARNING: HANDHELD CHAINSAWS ARE DANGEROUS MACHINES.

Before operating a chainsaw:

  1. Read the complete manufacturer's manual.
  2. Understand all safety warnings.
  3. Check the chain, guide bar, chain brake and other safety components.
  4. Use appropriate protective equipment.
  5. Keep other people and animals away from the work area.
  6. Never operate a damaged or defective chainsaw.
  7. Never remove or bypass safety devices.
  8. Do not use the product for purposes for which it was not designed.
  9. Follow all maintenance and inspection requirements.
  10. Obtain appropriate training and competence where required.

HSE specifically advises that chainsaw users must be adequately trained and competent for the work they undertake, and appropriate protective clothing should be worn.
